Narrative Summary
Summary
York County Council held a regular meeting on April 6, 2026, with six of seven members present (Andy Litten absent). The meeting opened with a memorial proclamation for late County Attorney Michael Kendree and included a $100,000 donation presentation from AT&T for Lazy Hawk Road improvements. A substantial portion of public comment centered on opposition to QTS data center operations in the county, with eight citizens speaking against the project. Council then moved through a full consent agenda and five first-reading rezoning public hearings, approving all items unanimously, before receiving a staff briefing on ongoing Land Use Code revision efforts.

Watchlist Flags
- Subdivision / Rezoning: Case #26-04 — Sand Tar Road, York (RMX-10 to RUD, 8.38 acres) — Council approved first reading of a rezoning to facilitate the division of 8.38 acres into six single-family lots; the RUD designation removes open space requirements that applied under RMX-10. One neighbor (William Bergin, 2224 Duck Cove Lane, York) spoke in opposition.
> "The purpose is to facilitate the division of the lot into six total lots. The proposed subdivision will create lots similar in scale to adjacent properties used for detached single-family homes. Single-family homes are permitted in both current and proposed zones, but rezoning to RUD will remove open space requirements."
- Rezoning: Case #26-06 — Highway 160 W, Fort Mill (PD to GC, 1.776 acres) — Council approved first reading of a rezoning for TWP Ft Mill Retail, LLC to allow two drive-through businesses under current General Commercial standards rather than 2008 Planned Development standards, despite the site being designated Neighborhood Residential on the York Forward 2035 Future Land Use Map.
> "The rezoning request is not consistent with the York Forward 2035 Future Land Use Map designation of Neighborhood Residential, but the property has frontage on Highway 160, abuts another parcel zoned GC, and proposed uses are consistent with existing PD."
- Rezoning: Case #26-07 — Gold Hill Road and Highway 21, Fort Mill (LI to GC, 50.803 acres) — Council approved first reading of a large commercial rezoning for Stephen McCrae consistent with the York Forward 2035 Future Land Use Map's I-77 Corridor designation, permitting hotels, offices, and restaurants.
> "The requested GC zone allows land uses that befit the I-77 Corridor future land use designation, including hotels, offices, and restaurants. Planning Commission recommended approval (7-0)."
- Subdivision / Rezoning: Case #26-08 — Highway 160, Fort Mill (condition amendment, 14.06 acres) — Council approved first reading of an amendment to conditions from prior case 25-09, allowing applicant Lawrence Shaheen to shift from age-restricted townhomes to multi-family condo buildings of 4-5 dwellings each on 14.06 acres.
> "The request amends a condition restricting use of the property to age-restricted townhomes. The applicant is now considering townhomes due to spacing requirements, and now pursue multi-family buildings of 4-5 dwellings each instead. The units will be condos instead of townhomes."
- Rezoning: Case #26-09 — 4070 Charlotte Highway, Clover (UD to GC, 0.81 acres) — Council approved first reading of a rezoning for Mariah Corkhill to expand the potential commercial tenant mix; the site is designated Village Center on the Future Land Use Map but is surrounded by existing General Commercial zoning.
> "The rezoning request is not consistent with York County's York Forward 2035 Future Land Use Map designation of Village Center, but the general area is dominated by business operations, and nearby properties have been rezoned to GC for similar purposes."

Council to provide Estoppel certification of Fee in Lieu of Tax Agreement between York County and Mountain SC LLC
York County previously entered into a Fee-in-Lieu of Tax and Incentive Agreement dated December 6, 2010, with Mountain SC LLC and Federal Express Corporation for property located at 3058 Lakemont Blvd and 2966 Lakemont Blvd in Fort Mill. The property owner is seeking financing through Wells Fargo Bank. As part of the financing process, the lender has requested that York County execute an Estoppel Certificate to confirm the status of the existing incentive agreement. The Estoppel Certificate does not modify the existing agreement or create any new financial obligations for York County.
